  • User – any natural person, legal entity, or organizational unit without legal personality that uses the Website.
  • Content – all materials available on the Website, including texts, graphics, photos, videos, and website code.
  • AI Assistant – an automated telephone service powered by artificial intelligence (AI), available at the phone number indicated on the Website. The AI Assistant handles incoming calls and conducts voice conversations using AI technology provided by Eleven Labs, Inc.

II. General Provisions

1. These Terms of Use govern the rules of using the Website cre8eve.eu.
2. Use of the Website constitutes acceptance of the provisions of these Terms of Use.
3. The Website serves to present the Controller's offerings, including consulting, mentoring, B2B services, and VR solutions.
4. The Controller provides an AI-powered telephone service, accessible at the phone number listed on the Website. By calling this number, the User agrees to interact with an AI system. The User is informed at the beginning of each call that they are speaking with an AI Assistant.
5. Use of the Website and the AI telephone service is voluntary and free of charge.

III. Rules of Using the Website

1. The User undertakes to use the Website in a manner consistent with the law, good practices, and the provisions of these Terms of Use.
2. It is prohibited to:

  • use the Website in a manner contrary to the law or these Terms of Use,
  • take actions that may disrupt the proper functioning of the Website,
  • attempt to gain unauthorized access to the Controller's systems,
  • copy, modify, or distribute Content without the Controller's consent,
  • use the Website for commercial purposes without the Controller's consent.

IV. Copyright and Intellectual Property

1. All Content available on the Website, including texts, graphics, logos, photos, videos, and website code, is the property of the Controller or has been used with the consent of its owners and is protected by copyright law.
2. Copying, modifying, distributing, or using Content without prior written consent from the Controller is prohibited.
3. Browsing Content for personal, non-commercial use only is permitted.

V. AI-Powered Telephone Service

1. The Controller provides an AI-powered telephone service for handling customer inquiries. The service is available at the phone number listed on the Website.
2. In accordance with Art. 50 of Regulation (EU) 2024/1689 (EU AI Act), every caller is informed at the beginning of the conversation that they are interacting with an AI system.
3. The AI Assistant provides general information about the Controller's services. Responses generated by the AI system are informational in nature and do not constitute a binding offer, legal advice, or any form of contractual commitment.
4. The Controller is not liable for any inaccuracies in the AI Assistant's responses. The AI system may not always provide complete or fully accurate information.
5. The caller may disconnect the call at any time. During the conversation, the AI Assistant will provide information on how to contact a human representative. The User may also contact the Controller via email at info@cre8eve.eu.
6. Voice data and call metadata are processed in accordance with the Privacy Policy. Details about data processors (Twilio Inc. and Eleven Labs, Inc.) and international data transfers are described therein.

VI. Contact with the Controller

2. The Controller undertakes to provide a response within 14 business days from the date of receipt of the inquiry.

VII. Links to Third-Party Websites

1. The Website may contain links to third-party websites.
2. The Controller is not responsible for the content, privacy policies, or practices of third-party websites.
3. Use of third-party websites is at the User's sole risk.

VIII. Disclaimer of Liability

1. The Website is provided on an "as is" basis. The Controller does not guarantee continuous and uninterrupted availability of the Website.
2. The Controller makes every effort to ensure that the Content published on the Website is current and accurate, but is not responsible for any inaccuracies or errors.
3. The Controller is not liable for damages resulting from the use or inability to use the Website, except in cases resulting from the Controller's intentional fault.
4. The provisions of this section do not exclude or limit the Controller's liability arising from mandatory provisions of law, in particular towards consumers.

X. Applicable Law and Dispute Resolution

1. The law applicable to these Terms of Use and any disputes arising from the use of the Website is Polish law.
2. All disputes arising from the use of the Website will be resolved by Polish courts, subject to mandatory provisions regarding court jurisdiction and consumer rights to bring proceedings before a court with general jurisdiction.

XII. Final Provisions

1. In matters not regulated by these Terms of Use, the provisions of Polish law shall apply, in particular the Civil Code and the Act on the provision of electronic services.
2. If any provision of these Terms of Use is deemed invalid or ineffective, it does not affect the validity of the remaining provisions.
3. These Terms of Use are available free of charge on the Website in a form that allows them to be downloaded, saved, and printed.
